WHAT IS LOLER 1998 AND WHO DOES IT APPLY TO?

LOLER stands for the Lifting Operations and Lifting Equipment Regulations 1998. It applies to all businesses and organisations whose employees use lifting equipment, whether they own it or not. This includes employers, self-employed individuals, and those in control of lifting equipment.

What types of equipment are covered under LOLER?

LOLER covers any equipment used for lifting or lowering loads, including cranes, hoists, and lifts, plus lifting accessories like slings, shackles and eyebolts. It also applies to equipment used to lift people, which has stricter requirements.

What are the key requirements under LOLER?

Lifting operations must be:

  • Properly planned by a competent person
  • Appropriately supervised
  • Carried out safely

Additionally, lifting equipment must be:

  • Suitable for the task
  • Clearly marked with its Safe Working Load (SWL)
  • Subject to regular thorough examinations
How often should lifting equipment be inspected?

LOLER requires periodic thorough examinations:

  • Every 6 months for equipment lifting people
  • Every 12 months for other lifting equipment
  • Immediately after installation or major structural changes

What does a ‘thorough examination’ involve and who can carry it out?

A thorough examination is a detailed inspection by a competent person - someone with the necessary training, experience and knowledge. It includes checking structural integrity, safety devices, and wear and tear. The results must be documented and kept on file.

WHAT IS PUWER 1998 AND WHO DOES IT APPLY TO?
PUWER stands for the Provision and Use of Work Equipment Regulations 1998. It’s a UK legislation that requires employers and operators to ensure all work equipment is safe, suitable for its intended purpose, properly maintained, and regularly inspected.
 
What guidance supports PUWER?
PUWER is supported by an Approved Code of Practice. While not law, following the ACOP means you will normally be doing enough to comply. Health and Safety Executive (HSE) inspectors seek to secure compliance with the law and may refer to this guidance as illustrating good practice.

What counts as work equipment?
Work equipment covers any machinery, tools or installation for use at work, including equipment that employees provide for their own use. The scope is extremely wide and covers any activity involving work equipment, including starting, stopping, programming, setting, transporting, repairing, modifying, maintaining, servicing and cleaning

How often should lifting equipment be inspected under PUWER?

PUWER does not set fixed inspection intervals. Equipment must be inspected after installation and before first use, and wherever it is exposed to conditions that could cause it to deteriorate, it must be checked regularly enough to catch faults before they become a risk. 

How often that is in practice will depend on the equipment itself, how heavily it is used, the working environment and what the manufacturer recommends.
 
What applies when buying new equipment?
 
When providing new work equipment, you must ensure it conforms with the essential requirements of relevant product supply law. You must check it has appropriate conformity marking and is labelled with the manufacturer's details, comes with a Declaration of Conformity, is provided with instructions in English, and is free from obvious defects
 
What does a PUWER inspection involve and who can carry it out?
A PUWER inspection is a detailed check to confirm work equipment is safe and compliant. Depending on the equipment and how often it’s used, this can range from a simple visual check to a more in‑depth assessment that may involve dismantling components in line with manufacturer instructions.

The inspection must be carried out by a competent person, someone with the knowledge, experience, and judgement to identify defects and decide whether the equipment is safe to use.
